Political parties react to NHI Act judgment
Political parties in Parliament have responded to the ruling by the Constitutional Court, which upheld the striking down of certain sections of the National Health Act.
This judgement is seen as a setback to government’s healthcare reform plans.
Sections 36 to 49 of the Act would have required healthcare providers to obtain a Certificate of Need from government, before opening practices or expanding services.
The Concourt has now confirmed that these requirements are irrational, following it being challenged in the Pretoria High Court in 2024.
