Coles Supermarkets has been found guilty in federal court of misleading customers with false discount claims through its Down Down campaign, with 13 out of 14 examined products showing fake discounts where sale prices were higher than original prices. The ACCC successfully prosecuted Coles over 245 products, with the supermarket now facing penalties likely in the tens of millions of dollars, while Woolworths faces near-identical charges with a decision expected within weeks. The ruling found that products like Rexona deodorant were artificially marked up before being offered at inflated ‘discount’ prices.
