Impeachment Ruling | Separation of powers issue in the spotlight
The Western Cape High Court has granted President Cyril Ramaphosa’s urgent bid to halt Parliament’s impeachment committee—a decision raising fresh questions around the separation of powers.
Ramaphosa wanted the inquiry put on ice pending a judicial review of the Section 89 Independent Panel report, which found he had a case to answer regarding the Phala Phala theft.
The committee was set up after the Constitutional Court ruled in May that Parliament’s 2022 decision to reject the report was unconstitutional.
Some political parties argue the judgment suggests the judiciary and the executive may be stepping on Parliament’s toes.
