Nkabinde Enquiry | Batohi quits testifying citing unfairness


The Nkabinde Enquiry has rejected a request by counsel for former National Director of Public Prosecutions, Advocate Shamila Batohi, to have her withdrawal statement read into the record.
Batohi walked out during cross-examination in December 2025. She said she would only return if allowed to consult her legal team while under oath. The panel dismissed her request, ruling she would not be prejudiced if she continued testifying. The enquiry is probing the fitness of suspended South Gauteng Director of Public Prosecutions, Advocate Andrew Chauke. Dr Suhayfa Bhamjee is a Senior Lecturer at the UKZN, School of Law and joins us now for analysis.
